1. The Service

The Service provides tools intended to support focus and productivity, including features that may generate attention/focus-related metrics.

Camera and Local Processing

If you enable camera-based features, analysis runs locally on your device. Raw video/images of you are NOT uploaded to or stored on our servers. The Service may store derived results produced by local processing (such as metrics, timestamps, and session summaries) as described in the Privacy Policy.

2. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement.

3. Account Registration and Security

• You must provide accurate information and keep it up to date.
• You are responsible for safeguarding your account credentials and for all activity under your account.
• You must notify us promptly if you suspect unauthorized access by contacting contact@focuszen.io

4. Acceptable Use

You agree not to:

• Use the Service in any unlawful manner or in violation of these Terms.
• Attempt to gain unauthorized access to the Service, other accounts, or systems.
• Interfere with, disrupt, or degrade the Service (including by automated abuse, scraping that violates applicable law, or introducing malware).
• Reverse engineer, decompile, or attempt to extract source code or proprietary algorithms except to the extent permitted by applicable law.
• Circumvent security features or access controls.

5. Your Content and Feedback

5.1 Your Content

If you submit content to the Service (such as feedback, messages, or survey responses), you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and use that content solely to operate, maintain, and improve the Service and provide support.

5.2 Feedback

If you send suggestions or feedback, you agree we may use them without restriction and without compensation.

6. Privacy

Our Privacy Policy explains how we process personal data. By using the Service, you acknowledge that you have read and understood it.

In particular:

• Raw video/images are not uploaded to or stored by us.
• Derived results produced locally on your device may be transmitted to and stored by us to provide the Service.

7. Subscriptions and Payments

If you purchase a subscription:

• Fees, billing intervals, and included features are shown at the time of purchase.
• Subscriptions may renew automatically unless canceled before renewal.
• Payment processing may be handled by third-party payment providers. We generally do not store full payment card numbers.
• Refunds, if any, follow the policy shown at purchase and any mandatory platform rules.

If you do not purchase a subscription, you may have access only to free features or limited functionality.

8. Intellectual Property

The Service (including its software, design, text, graphics, logos, and algorithms), excluding your content, is owned by us and protected by intellectual property laws. You receive only the limited license described in these Terms. No other rights are granted.

9. Service Availability and Changes

We may modify, update, suspend, or discontinue the Service or any part of it at any time, including to improve performance, address security issues, comply with law, or evolve features. We do not guarantee uninterrupted availability.

10. Termination

10.1 By You

You may stop using the Service at any time. If the Service provides account deletion controls, you may delete your account through those controls or request deletion by emailing contact@focuszen.io

10.2 By Us

We may suspend or terminate your access if we reasonably believe:

• you violated these Terms,
• your use creates a security risk or harms the Service or other users,
• we must do so to comply with law.

Upon termination, your license to use the Service ends.

11. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE" to the maximum extent permitted by law. We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

The Service provides informational insights and productivity tools. It is not a medical device and does not provide medical advice.

12. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill.
• Our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid for the Service in the 12 months before the event giving rise to the claim. If you have paid nothing, our total liability will not exceed EUR 50.

Nothing in these Terms limits liability that cannot be excluded under applicable law.

13. Indemnification

You agree to indemnify and hold us harmless from claims, liabilities, damages, and expenses (including reasonable legal fees) arising out of or related to:

• your misuse of the Service,
• your violation of these Terms,
• your infringement of third-party rights.

14. Changes to These Terms

We may update these Terms at any time. We will post the updated Terms and revise the "Last updated" date above. Continuing to use the Service after changes take effect means you agree to the updated Terms, subject to any rights you may have under applicable law.
